However, laws are changing every day in regards to what and whom we can film. It is not as simple as being able to purchase cameras and mount them on your home and business. Compliance is essential for a home or business security system, and in many cases, that means putting up signage advising that you have CCTV cameras operating on your premises.

Unfortunately, there is no cut and dry answer to this because there is no common law pertaining to privacy, unlike other states. There have even been two High Court cases that both tried to establish a right to privacy, but both were unsuccessful.

However, that does not mean you have carte blanche to install cameras without signage as you please. There are NSW laws that pertain to the installation and management of listening and recording devices.

The Surveillance Devices Act 2007 (NSW)

This is the primary legislation that you will need to adhere to. The Surveillance Devices Act 2007 (NSW) essentially states that CCTV cameras can be installed unless the owner of the land they are being installed on expressly forbids it.

However, this only takes vision into consideration. So, if you have a CCTV camera setup without an audio recording device, you are in the clear. It is when you are also recording audio that there is confusion.

When Signage Is Required

If you are installing CCTV cameras on common ground in New South Wales without audio listening or recording devices, then you do not need to put up signage.

This changes if the common space is a workplace. In this instance, cameras need to be clearly visible and you must put up signage at every entrance that states that you are using a security monitoring service.

While this may sound draconian, it is a good thing. Would-be intruders are more likely to see the signage than they are to see the cameras themselves, so this acts as a deterrent against crime.

Typically they make calls to overseas premium-rate numbers. The owner of the premium rate service gets paid, the hacker gets a cut and you pick up the tab. Others do it just for fun and the challenge.

So why is this a problem now?

With the rollout of the NBN across Australia, the PSTN and ISDN network will be decommissioned and replaced with Session Initiated Protocol (SIP) Trunks. It’s this technology that can allow malicious activity on your telephone system unless properly secured.

Current proposed milestones in the decommissioning of the current ISDN network.

1st January 2018 – New ISDN services are no longer available for customers who do not already have ISDN in place.
30th June 2018 – Full cease on new or additional ISDN services for all customers. In other words, Telco’s aren’t accepting any new orders for ISDN.
June 2019 – Disconnections will commence.
Limit or restrict the phone numbers that can be dialled using restriction tables
By 2022 – All ISDN connections will be disconnected and the ISDN network decommissioned.

When connecting to the NBN, current services are converted to SIP trunks and are connected to the phone system either directly, on SIP supported systems, or via an Integrated Access Device (IAD). When connected directly, SIP Trunks should be connected via an SBC.

NEC has announced an increased choice of terminals for the SL1100 phone system with the inclusion of the DT430 series handsets, normally only available on the SV9000 series systems. Now you won’t be restricted to the standard SL1100 handset.

Beware NBN Scammers!

We are aware of some service prov iders that are currently targeting the Newcastle and Hunter area through cold calling, trying to convince you that either your existing telephone system, telephone lines or both are incompatible with the NBN and need to be replaced.

Whilst this may be true in some cases most of the time this is simply incorrect. One of our customers was convinced this was the case and contacted us and asked why the system we recently upgraded needed to be replaced. Both the telephone system and existing telephone lines were not affected by the NBN rollout.

Beware of these unscrupulous operators and if you are uncertain contact us for an honest evaluation of your NBN readiness.
